Child Car Seat Safety Policy
Availability & Booking Requirements
Child restraint systems, including infant seats, convertible seats, and booster seats, are available upon advance request, subject to availability. Requests must be made at least 24 hours before the scheduled pickup and confirmed by the Company. At the time of booking, the parent or guardian must provide the child’s age, weight, and height to ensure a suitable seat can be supplied. Failure to provide accurate information may prevent the Company from fulfilling the request. Additional fees may apply for each seat requested.
Parent & Guardian Responsibilities
The parent, legal guardian, or accompanying responsible adult bears sole responsibility for determining that the seat is appropriate for the child based on age, height, weight, and applicable law; reviewing all manufacturer instructions and warnings; verifying that the seat is properly installed and secured; securing the child correctly before and throughout the journey; and ensuring compliance with all federal, state, and local child passenger safety laws. Prior to departure, the responsible adult must inspect the restraint system and confirm the child is properly secured. Accepting transportation services constitutes acknowledgment that this inspection has been completed.
Limitations of the Company’s Role
The Company, its chauffeurs, drivers, employees, affiliates, and agents are not certified Child Passenger Safety Technicians unless specifically stated otherwise. While the Company may provide and position a child safety seat as a convenience, it does not offer professional advice on the selection, suitability, installation, adjustment, or use of any restraint system, and does not warrant or guarantee that any seat has been correctly installed for a specific child. No Company representative assumes responsibility for verifying the installation, fit, or continued use of the restraint system during transportation.
Liability Disclaimer & Legal Compliance
To the fullest extent permitted by applicable law, the Company disclaims any liability arising from the selection, installation, adjustment, fit, inspection, maintenance, condition, or use of any child restraint system, except where such liability cannot be waived by law. Nothing in this policy waives or limits any obligation imposed on the Company by applicable federal, state, or local law. Where applicable law assigns responsibility for child restraint compliance to a parent, guardian, or accompanying adult, that responsibility remains solely with that individual.
Cancellations, No-Show, and Refunds
- Cancellation Policy: Cancellations must be made within the timeframes specified (2 hours for sedans, 48 hours for stretch limos, etc.). No-show fees apply if a passenger fails to show up at the designated time.
- Refunds: No refunds are available for cancellations outside of designated timeframes or due to circumstances beyond our control, such as road closures or severe weather.
Dispute Resolution and Alternative Dispute Mechanisms
Disputes should be handled initially through our support team. For unresolved issues, we offer mediation and arbitration as alternative dispute resolution (ADR) options, per Illinois State Bar Association guidelines.
- Online Dispute Resolution (ODR): Secure web-based platforms facilitate online mediation and arbitration, ensuring confidentiality and compliance with the Uniform Mediation Act.
Intellectual Property and Copyright Protection
Black Car Everywhere’s branding, website content, and service descriptions are protected by Illinois copyright laws. Unauthorized use, reproduction, or distribution of our materials may result in legal action.
Compliance with Illinois and U.S. Regulations
- Transport of Children and Luggage Policies: Compliance with the Illinois Child Passenger Protection Act and state regulations on luggage capacity ensures safe transportation for all passengers.
- Vehicle Upgrades and Inspections: Our fleet is updated regularly to comply with Illinois Department of Transportation safety standards.
