Passenger Responsibilities, Safety Rules, Prohibited Conduct

Passengers must:

  1. comply with lawful Chauffeur instructions
  2. act respectfully
  3. use available seat belts
  4. supervise minors
  5. protect the vehicle
  6. avoid distracting the Chauffeur
  7. remain seated while the vehicle is moving
  8. keep aisles and exits clear
  9. comply with applicable law
  10. disclose relevant transportation needs
  11. avoid conduct that threatens safety, property, or service continuity.

Passengers must use seat belts and occupant restraints whenever required by law or directed by the Chauffeur. The Booker is responsible for ensuring that minors are properly restrained.

No Passenger may disable, misuse, obstruct, or refuse an available legally required restraint. The Chauffeur may refuse to move the vehicle until safety requirements are satisfied.

A responsible adult must accompany a minor unless the Company has expressly accepted an authorized unaccompanied-minor arrangement in writing.

The Booker is responsible for:

  1. disclosing each child’s age, height, and weight when relevant
  2. requesting an appropriate child seat
  3. verifying the seat type
  4. securing the child
  5. ensuring lawful use
  6. inspecting the installation before departure.

The Company may provide a requested seat as a convenience but cannot guarantee availability unless confirmed.

A Chauffeur may assist but is not responsible for determining whether a seat is appropriate for a particular child.

A parent or legal guardian retains responsibility for compliance with child-restraint laws unless applicable law provides otherwise.

The Company may refuse transportation when a child cannot be transported safely and lawfully.

Passenger capacity may not exceed:

  1. the number of installed lawful seating positions
  2. the manufacturer’s limitations
  3. legal capacity
  4. insurance limitations
  5. the safe capacity determined by the Chauffeur.

No standing passengers are permitted unless the vehicle is specifically designed, licensed, and legally authorized for standing travel.

Passengers must not bring property that:

  1. exceeds safe storage capacity
  2. blocks the Chauffeur’s view
  3. obstructs doors or exits
  4. cannot be secured
  5. creates a hazard
  6. is unlawful
  7. is likely to damage the vehicle
  8. exceeds disclosed size or weight limits.

The Company may require an additional vehicle for excessive luggage.

The Company is not responsible for damage caused by inadequate packaging, fragile contents, ordinary handling, hidden defects, or Passenger loading instructions, except to the extent responsibility cannot lawfully be excluded.

Passengers should provide reasonable advance notice of:

  1. wheelchair or mobility-device dimensions
  2. transfer requirements
  3. accessible-vehicle needs
  4. assistance needs
  5. service-animal travel
  6. other accommodations.

The Company will make reasonable efforts to provide lawful accommodations and will not discriminate on the basis of disability.

Availability of a specific accessible vehicle may depend on location, notice, equipment, Affiliate availability, and applicable regulatory requirements.

No provision of these Terms limits legally protected accessibility rights.

Service animals are permitted as required by applicable law.

A “no pets” rule does not apply to a qualifying service animal where the law requires access. The Passenger remains responsible for the animal’s:

  1. control
  2. behavior
  3. sanitation
  4. care
  5. any damage beyond ordinary wear.

The Company may take lawful action where an animal is out of control, not housebroken, or presents a direct safety threat, but will not impose an unlawful pet fee for a qualifying service animal.

Pets and non-service animals require advance approval. The Company may require:

  1. an appropriate carrier
  2. protective covering
  3. vehicle-category restrictions
  4. cleaning fees
  5. additional time
  6. a specific Affiliate.

A Passenger must disclose an animal before pickup. Unauthorized animals may be refused where lawful.

Passengers must determine whether standard chauffeured transportation is appropriate for their condition.

The Company does not provide:

  1. medical monitoring
  2. clinical care
  3. lifting services
  4. emergency response
  5. oxygen management
  6. medication administration
  7. medical transportation unless separately licensed and expressly contracted.

A passenger requiring medical supervision must travel with an appropriate caregiver. Medical equipment must be disclosed and safely secured.

In an emergency, the Chauffeur may contact emergency services and follow reasonable safety procedures.

The Passenger is responsible for emergency-service charges except where applicable law provides otherwise.

A passenger should not travel when doing so creates an unreasonable health or safety risk. The Company may refuse or terminate service when a Passenger:

  1. presents a direct threat
  2. cannot remain safely seated
  3. requires unavailable medical assistance
  4. is actively vomiting or severely ill
  5. has a condition that makes ordinary transportation unsafe
  6. requires emergency treatment.

Any decision will be made based on available information, safety, applicable law, and reasonable accommodation duties.

Alcohol may be possessed or consumed only when:

  1. permitted by law
  2. permitted by vehicle licensing
  3. permitted by the vehicle owner
  4. approved by the Company
  5. all consuming Passengers are of lawful age
  6. consumption does not create a safety risk.

The Company may prohibit alcohol in any vehicle.

The Chauffeur may stop alcohol consumption or terminate service when a Passenger becomes disorderly, threatening, incapacitated, or unsafe.

The Booker is responsible for ensuring compliance with age and alcohol laws.

Possession, use, sale, transfer, or transportation of illegal drugs or unlawfully possessed controlled substances is prohibited.

The Chauffeur may terminate service and contact law enforcement where reasonably necessary or legally required.

No refund is due for service terminated because of unlawful conduct, except where applicable law requires otherwise.

Passengers may not:

  1. smoke
  2. vape
  3. burn incense
  4. light candles
  5. ignite any substance
  6. use an open flame
  7. use any device producing smoke or combustible vapor.

This prohibition applies even where the substance is otherwise lawful.

Weapons, explosives, fireworks, flammable materials, hazardous chemicals, and dangerous articles are prohibited unless:

  1. possession is lawful
  2. transportation is lawful
  3. the Company gave prior written approval where approval is legally permitted
  4. the item is stored and secured as required by law.

The Company may impose a stricter no-weapons policy where lawful.

Law-enforcement officers acting within their authority may be treated according to applicable law and written arrangements.

The following are prohibited:

  1. assault
  2. fighting
  3. threats
  4. intimidation
  5. stalking
  6. coercion
  7. throwing objects
  8. aggressive physical conduct
  9. deliberate interference with the Chauffeur
  10. conduct creating a reasonable fear of harm.

The Chauffeur may stop at a safe location, terminate service, request police assistance, or take reasonable protective action.

Passengers may not harass, abuse, insult, threaten, or discriminate against a Chauffeur, greeter, dispatcher, Affiliate employee, other Passenger, or member of the public.

Prohibited conduct includes harassment based on legally protected characteristics. Sexual harassment, unwanted touching, indecent exposure, and sexually threatening conduct are prohibited.

Passengers may not:

  1. touch the steering wheel or vehicle controls
  2. obstruct mirrors
  3. interfere with navigation
  4. open doors while moving
  5. throw objects from the vehicle
  6. demand unlawful speed
  7. demand unsafe driving
  8. encourage traffic violations
  9. obstruct the Chauffeur’s hearing or vision
  10. create excessive noise that interferes with safe operation.

The Chauffeur has final authority over safe vehicle operation.

The Company may refuse or terminate service for a Passenger whose intoxication or behavior creates a reasonable safety, property, or legal risk. When reasonably possible, the Chauffeur may stop at a safe public location or seek assistance.

The Company is not responsible for supervising an intoxicated Passenger after service is lawfully terminated, but will not abandon a Passenger in circumstances where doing so would violate applicable law or create an unreasonable and foreseeable danger.

Food and nonalcoholic beverages may be restricted by vehicle type or local policy. Passengers must avoid:

  1. open containers likely to spill
  2. staining foods
  3. uncovered hot liquids
  4. glassware where prohibited
  5. strong odors
  6. excessive mess
  7. food that creates an allergy or sanitation hazard.

The Passenger is responsible for resulting cleaning or damage.

Passengers must use vehicle features safely. Passengers may not:

  1. stand through a sunroof
  2. hang outside a window
  3. sit on the exterior
  4. operate emergency exits without cause
  5. remove vehicle equipment
  6. disable safety systems
  7. tamper with cameras or telematics
  8. damage entertainment systems
  9. use doors while the vehicle is moving.

Decorations require advance approval.

The following are prohibited unless expressly approved:

  1. adhesives
  2. paint
  3. confetti
  4. glitter
  5. open flames
  6. sharp objects;
  7. items obstructing windows, lights, plates, mirrors, or safety equipment
  8. materials likely to stain or damage the vehicle.

The Booker is responsible for installation, removal, cleaning, and damage unless a separate agreement states otherwise.

Passengers may take lawful personal photographs or recordings provided they do not:

  1. distract the Chauffeur
  2. interfere with safety
  3. violate another person’s privacy
  4. record confidential business information
  5. obstruct operation
  6. use the Company’s trademarks commercially without permission.

Commercial filming, advertising, staged productions, and professional shoots require advance written approval.

Vehicles may use lawful safety and operational systems, including:

  1. GPS
  2. dash cameras
  3. exterior cameras
  4. event recorders
  5. speed and braking data
  6. route history
  7. vehicle diagnostics
  8. communications records
  9. other telematics.

Any in-cabin audio or video recording will be used only where lawful and subject to required notice or consent.

Information may be used for:

  1. safety
  2. dispatch
  3. incident investigation
  4. insurance
  5. legal compliance
  6. dispute resolution
  7. fraud prevention
  8. service improvement.

Data handling is governed by the applicable Privacy Policy and law.

The Booker and Passenger authorize service-related communications using supplied contact information, including:

  1. booking confirmations
  2. Chauffeur details
  3. pickup instructions
  4. delay notices
  5. payment messages
  6. customer-service communications
  7. telephone calls
  8. email
  9. text messages.

Consent to transactional communications is part of service administration.

Marketing communications will be handled separately in accordance with applicable law and stated consent choices.

Message and data rates may apply.

The Services may not be used to facilitate:

  1. human trafficking
  2. commercial sexual exploitation
  3. illegal gambling
  4. drug distribution
  5. theft
  6. fraud
  7. evasion of law enforcement
  8. transportation of stolen property
  9. unlawful weapons activity
  10. money laundering
  11. any other unlawful purpose.

The Company may preserve and disclose relevant information where legally required or reasonably necessary to protect safety and legal rights.

The Booker is responsible for informing guests of these rules.

Where legally permitted, the Booker may be responsible for charges and damage caused by the Booker’s guests, invitees, employees, clients, minors, or event attendees.

When service is terminated, Passengers must exit at a safe and lawful location as directed. A passenger refusing to exit may be treated as trespassing, and law enforcement may be contacted.

The Chauffeur will consider safety, weather, location, disability accommodations, and other relevant circumstances when selecting a stopping point.

Passengers should promptly report:

  1. unsafe driving
  2. harassment
  3. discrimination
  4. unauthorized gratuity demands
  5. suspected impairment
  6. vehicle defects
  7. accidents
  8. injuries
  9. property damage
  10. inappropriate conduct
  11. other serious concerns.

Reports should include the reservation number, date, approximate time, location, description, and available supporting evidence.

Emergency matters should be reported to emergency services first.

By making, paying for, accepting, or using a reservation, the Booker and Passenger acknowledge that they:

  1. reviewed the reservation information
  2. received or had access to these Terms
  3. understand the applicable cancellation and waiting-time rules
  4. authorize the stated and properly incurred charges
  5. accept the passenger conduct and safety requirements
  6. understand that exact vehicles and arrival times are not guaranteed
  7. understand that Services may be performed by an Affiliate
  8. accept the limitation-of-liability provisions to the extent permitted by law
  9. accept the individual arbitration provision unless timely opted out.
