PRICING, PAYMENTS, CANCELLATIONS, REFUNDS, AND OPERATIONAL POLICIES

Unless expressly stated otherwise, a quote is an estimate based on the information supplied at the time.

A quote may expire at the time stated or, if no time is stated, when availability, itinerary, taxes, fees, or operating conditions change.

A quote may be adjusted when:

  1. pickup or destination information changes
  2. the flight changes
  3. passenger count changes
  4. vehicle category changes
  5. luggage requirements change
  6. stops are added
  7. service duration increases
  8. waiting time occurs
  9. parking or tolls apply
  10. event restrictions apply
  11. taxes or governmental fees change
  12. the trip extends beyond the quoted service area
  13. the Booker supplied incorrect or incomplete information.

Obvious typographical, software-generated, system, display, or calculation errors may be corrected before or after Confirmation, subject to applicable consumer law.

Charges may include:

  1. base fare
  2. hourly charges
  3. minimum rental charges
  4. mileage
  5. travel time
  6. garage-to-garage time
  7. repositioning
  8. deadhead mileage
  9. fuel surcharge
  10. gratuity or service charge
  11. tolls
  12. parking
  13. airport fees
  14. permit fees
  15. congestion charges
  16. taxes
  17. meet-and-greet fees
  18. waiting time
  19. additional stops
  20. early-morning or late-night charges
  21. holiday or event premiums
  22. cleaning
  23. damage
  24. child-seat fees
  25. Affiliate charges
  26. credit-card processing fees where lawful and disclosed
  27. currency-conversion charges
  28. other amounts described in the quote or Confirmation.

The Confirmation should be reviewed to determine which amounts are included and which are additional.

A quoted amount may include a Chauffeur gratuity, administrative service charge, or both. The Confirmation controls.

A mandatory service charge may not be paid entirely to the Chauffeur and may be retained or allocated by the Company or Affiliate for administrative and operational purposes, subject to applicable law.

Any additional voluntary gratuity is at the Passenger’s discretion.

No Chauffeur may demand an additional gratuity where gratuity is already included. Concerns should be reported promptly to the Company.

The Booker is responsible for applicable taxes, tolls, parking, airport charges, permit charges, congestion charges, ferry fees, border charges, and governmental assessments unless expressly included in the quoted total.

Estimated tolls or parking may be reconciled after service.

If a Passenger requests a route involving additional tolls, parking, or access fees, those charges may be added.

The Booker and cardholder authorize the Company and its payment processors to:

  • verify the payment method
  • obtain an authorization hold
  • charge deposits
  • charge the estimated fare
  • charge the final fare
  • charge approved modifications
  • collect cancellation or no-show fees
  • collect waiting, overtime, toll, parking, cleaning, damage, or other authorized charges
  • correct billing errors
  • reprocess a declined or reversed transaction where lawful.

An authorization hold is not necessarily a final charge and may temporarily reduce available credit or funds.

The issuing bank controls when a hold is released.

The Company may accept credit cards, debit cards, electronic payments, approved corporate billing, Zelle, Venmo, Cash App, wire transfer, or other methods at its discretion.

Availability of a payment method does not waive the Company’s right to require:

  • a valid card on file
  • identity verification
  • a deposit
  • advance payment
  • a signed authorization
  • an alternative guaranteed payment method.

Cash payment is permitted only when expressly approved.

The Company may require a deposit or full payment when booking:

  1. specialty vehicles
  2. weddings
  3. proms
  4. concerts
  5. major events
  6. group transportation
  7. long-distance trips
  8. holiday service
  9. multi-day service
  10. high-value reservations
  11. service requiring dedicated equipment.

The Confirmation will state whether a deposit is refundable, nonrefundable, or subject to a cancellation schedule.

A deposit compensates the Company for reserving capacity, planning service, declining other work, and incurring preparatory expenses; it is not necessarily a penalty.

The Booker, Account Holder, cardholder, and entity receiving Services are jointly and severally responsible for all properly authorized charges to the extent permitted by law, unless the Company agrees otherwise in writing.

The Company may seek payment from any responsible party but will not collect more than the total amount lawfully owed.

A dispute between a Booker, Passenger, employer, travel agent, event organizer, or cardholder does not eliminate payment responsibility to the Company.

When payment is declined, reversed, disputed, blocked, or otherwise unavailable, the Company may:

  1. request another payment method
  2. suspend or cancel the reservation
  3. withhold future Services
  4. charge reasonable returned-payment costs where lawful
  5. collect amounts due
  6. refer the account for collection
  7. pursue available legal remedies.

The Passenger may be responsible for reasonable collection expenses and attorney fees only where permitted by law and awarded under a valid contract or legal process.

A billing question should be submitted promptly with:

  1. reservation number
  2. service date
  3. Passenger name
  4. disputed amount
  5. explanation
  6. supporting documentation

The Company may correct undercharges, overcharges, duplicate charges, omitted tolls, calculation errors, and payment-processing errors, subject to applicable law.

An overpayment confirmed by the Company will be refunded or credited through a reasonable method.

Before initiating a chargeback, the Booker should contact the Company and allow a reasonable opportunity to investigate.

Initiating a chargeback does not cancel a valid payment obligation. The Company may submit to the card issuer:

  1. these Terms
  2. reservation records
  3. electronic acceptance records
  4. communications
  5. GPS or telematics records
  6. dispatch records
  7. vehicle records
  8. photographs
  9. Chauffeur statements
  10. receipts
  11. signatures
  12. other evidence relevant to the transaction.

The Company will not penalize a consumer merely for exercising a lawful billing-dispute right. Fraudulent, knowingly false, or abusive payment disputes may result in suspension of service and lawful collection activity.

Any modification is subject to availability and may result in repricing.

A modification may be treated as a cancellation and new booking when it materially changes:

  1. the date
  2. pickup time
  3. pickup city
  4. airport
  5. destination
  6. service duration
  7. vehicle category
  8. passenger capacity
  9. route
  10. event
  11. number of vehicles
  12. operational requirements.

A modification is effective only when accepted by the Company. Sending a request does not guarantee acceptance.

The cancellation deadline and applicable fee are stated in the quote, contract, rate sheet, or Confirmation control.

If no specific cancellation rule is stated, the Company’s then-current published cancellation policy for the service category and location will apply, subject to applicable law.

Cancellation deadlines may vary based on:

  1. location
  2. vehicle type
  3. trip value
  4. event
  5. service duration
  6. Affiliate requirements
  7. holiday or high-demand period
  8. whether the vehicle or personnel have been dispatched.

A cancellation is effective only when received and acknowledged through an authorized Company channel.

A Passenger should retain the cancellation reference or written acknowledgment.

Special-Use Vehicles, weddings, proms, group service, roadshows, major events, and multi-day reservations may have longer cancellation deadlines.

Where stated in the Confirmation, a deposit may become nonrefundable once:

  1. the vehicle is reserved
  2. the cancellation deadline passes
  3. dedicated personnel are assigned
  4. special preparation begins
  5. permits or staging arrangements are made
  6. the Company incurs nonrecoverable expenses.

Event-specific cancellation provisions control over general cancellation provisions.

A reservation may be classified as a no-show when the Passenger:

  1. cannot be located
  2. does not respond to reasonable calls or messages
  3. fails to appear within the applicable waiting period
  4. leaves the pickup location without notifying the Company
  5. boards other transportation without canceling
  6. provides an incorrect pickup location and cannot be reached
  7. fails to follow airport pickup instructions.

Before declaring a no-show, the Company or Chauffeur will ordinarily make reasonable efforts to contact the Passenger using the information provided, considering safety and operational circumstances.

A no-show may be charged up to the full reservation amount, plus waiting, parking, tolls, and other incurred charges, subject to applicable law.

Unless the Confirmation states otherwise, the standard complimentary waiting period is:

  1. Domestic flight arrival: up to 45 minutes.
  2. International flight arrival: up to 75 minutes.

The waiting period ordinarily begins at the actual gate-arrival time shown by the flight-tracking source used by the Company, or at another time specified in the Confirmation.

If accurate flight information was not supplied, the waiting period may begin at the scheduled pickup time.

After the complimentary period:

  1. waiting charges may begin
  2. the Chauffeur may continue waiting if available
  3. the reservation may convert to hourly billing
  4. the Chauffeur may be released
  5. the trip may be classified as a no-show
  6. alternative arrangements may be required.

Customs, immigration, baggage, security, and terminal delays are included within the complimentary period unless the Confirmation provides otherwise.

Passengers anticipating delay should contact dispatch immediately.

Unless otherwise stated, point-to-point sedan and SUV reservations include a grace period of up to 15 minutes from the scheduled pickup time.

After the grace period:

  1. waiting charges may apply
  2. the Chauffeur may continue waiting if available
  3. the trip may be repriced
  4. hourly minimums may apply
  5. the Chauffeur may be released if continued waiting would interfere with safety, legal driving limits, or another reservation.

Different grace periods may apply to vans, Sprinters, buses, specialty vehicles, events, hourly service, and Affiliate-operated trips.

Waiting time may be calculated by the minute, in billing increments, or under hourly minimums, as stated in the Confirmation or applicable rate schedule.

Waiting charges may apply to:

  1. late Passengers
  2. delayed meetings
  3. additional luggage time
  4. venue delays
  5. unscheduled stops
  6. customs and immigration delays beyond the grace period
  7. incorrect pickup information
  8. private aviation delays
  9. delayed group loading
  10. any period during which the vehicle and Chauffeur remain committed to the Passenger.

Waiting time does not guarantee that the Chauffeur can remain indefinitely.

A Chauffeur may arrive before the scheduled pickup time.

Early arrival does not require the Passenger to depart early and does not ordinarily cause billable waiting time to begin before the confirmed pickup time.

For hourly or specially contracted services, the applicable agreement controls.

If a Passenger chooses to depart before the confirmed pickup time, the Passenger accepts the risks associated with the changed itinerary.

The Company is not required to provide service early unless operationally available.

Refund eligibility depends on:

  1. the reason for cancellation
  2. timing
  3. service category
  4. vehicle type
  5. expenses incurred
  6. whether personnel or vehicles were dispatched
  7. whether service was provided
  8. whether a replacement was accepted
  9. the Confirmation
  10. applicable law.

Approved refunds will ordinarily be issued to the original payment method. Banks and payment processors control posting time.

Processing delay by a financial institution is outside the Company’s control.

The Company may offer a service credit as a customer-service accommodation. Unless expressly stated:

  1. a credit has no cash value
  2. it is nontransferable
  3. it may expire
  4. it applies only to future Company Services
  5. it cannot be combined with another offer
  6. issuance is not an admission of liability.

A Passenger is not required to accept a service credit in place of a refund that is legally required.

Promotional codes, discounts, vouchers, and special rates:

  1. may be limited by date, location, vehicle, account, or service type
  2. may not be combined
  3. may be nontransferable
  4. may exclude taxes and fees
  5. may be revoked for fraud or misuse
  6. have no cash value unless required by law.

The Company may correct or withdraw a promotion published in error, subject to applicable law.

The Booker and Passengers are responsible for unusual cleaning required because of their conduct or property.

Chargeable conditions may include:

  1. vomiting
  2. bodily fluids
  3. smoking residue
  4. excessive food or beverage spills
  5. glitter
  6. wax
  7. confetti
  8. mud
  9. animal waste
  10. biohazard contamination
  11. stains
  12. excessive trash
  13. odor
  14. gum
  15. cosmetics
  16. other conditions requiring professional cleaning or vehicle downtime.

The charge may include reasonable:

  1. cleaning expenses
  2. sanitation
  3. detailing
  4. biohazard treatment
  5. odor removal
  6. repair
  7. transportation
  8. lost operating time
  9. documented third-party costs.

The Company may rely on photographs, Chauffeur reports, vendor invoices, inspection records, or other reasonable evidence.

Smoking, vaping, burning substances, and use of electronic smoking devices are prohibited unless the Company expressly confirms a specially designated arrangement in writing.

A violation may result in:

  1. immediate termination of service
  2. cleaning or deodorizing charges
  3. repair charges
  4. vehicle-downtime charges
  5. penalties imposed by an Affiliate or vehicle owner
  6. denial of future service.

Charges must be commercially reasonable and related to actual or reasonably anticipated loss, subject to applicable law.

The Booker and responsible Passenger are liable for damage caused intentionally, recklessly, negligently, or through violation of these Terms.

Recoverable amounts may include reasonable:

  1. repair or replacement
  2. cleaning
  3. towing
  4. inspection
  5. administrative handling
  6. loss of vehicle use
  7. diminished value where legally recoverable
  8. third-party charges
  9. taxes.

Ordinary wear and tear is not chargeable.

The Company will provide reasonable supporting information upon request.

Additional service requested or received may be billed after the reservation. Where exact pricing cannot be confirmed immediately, the Booker authorizes commercially reasonable charges based on the applicable rate schedule and services actually supplied.

A Chauffeur’s informal statement does not modify the rate unless authorized by the Company.

A disclosed surcharge may apply when extraordinary conditions materially increase operating costs, including:

  1. severe fuel-price disruption
  2. road closures
  3. emergency restrictions
  4. snow or ice
  5. mandatory chains
  6. special permits
  7. remote repositioning
  8. evacuation conditions
  9. government-imposed costs.

The Company will not impose an undisclosed surcharge prohibited by applicable law.

Vehicles are mechanical equipment and may experience unexpected failures despite inspection and maintenance.

If a mechanical problem occurs, the Company may attempt to:

  1. repair the issue
  2. provide a replacement
  3. arrange an Affiliate
  4. divide the group among vehicles
  5. provide alternate transportation
  6. refund the affected portion.

Acceptance of a reasonable replacement ordinarily constitutes fulfillment of the transportation obligation for the affected segment, without waiving claims that cannot lawfully be waived.

Passengers are responsible for their belongings at all times.

The Company does not take custody of luggage or property merely because a Chauffeur assists with loading or unloading.

A lost-property report should include:

  1. reservation number
  2. vehicle or Chauffeur information
  3. item description
  4. last known location
  5. contact information
  6. proof of ownership if requested.

The Company may attempt to locate an item but does not guarantee recovery.

Recovered property may be:

  1. held for a limited period
  2. returned at the owner’s expense
  3. shipped through a third party
  4. transferred to police or airport authorities
  5. donated
  6. discarded after a reasonable period, subject to applicable law.

The Passenger is responsible for reasonable delivery, shipping, storage, parking, toll, and Chauffeur costs associated with returning property.

High-value items should never be left unattended.
